Fed Dist Judge W M Byrne Jr is expected to rule on Govt's motion, made during wk of July 9, to keep out of public record 4 unpublished volumes of Pentagon papers, which defense wishes to use as evidence in prosecuting D Ellsberg and A J Russo; defense attys protest that new precedent would be set if Byrne agrees to let volumes be used as evidence and discussed freely during trial, but still kept secret from press and public; says that to do so will deny Ellsberg and Russo guarantee of public trial, because Govt would be prosecuting them on evidence that would be kept from public
