Florida: Padilla Lawyers Can Question Officials

Lawyers for Jose Padilla, seeking to prove he is unfit to stand trial, won the right to question government personnel who observed him at a Navy brig and a federal detention center. Judge Marcia Cooke of Federal District Court in Miami ordered eight Defense Department and Justice Department officials to appear for questioning at Mr. Padilla’s competency hearing next Thursday. The eight were previously interviewed for a United States Bureau of Prisons report that prosecutors cite as evidence that Mr. Padilla is mentally competent. Mr. Padilla, a 36-year-old American citizen accused of being an operative for Al Qaeda, is scheduled to go on trial April 16.
